These Terms of Service ("Terms") govern your access to and use of the Locaro iOS application ("Locaro", the "Service"), operated by an individual founder based in Canada ("Locaro", "we", "our", "us"). By creating an account or using the Service, you agree to these Terms.
1. Acceptance
By installing, accessing, or using Locaro, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use Locaro.
2. Eligibility
You must be at least 13 years old to use Locaro, or older if required by the laws of your country. By using the Service, you represent that you meet this requirement.
3. Your account
- You are responsible for safeguarding your sign-in credentials.
- You may not impersonate another person or misrepresent your affiliation.
- You may not sell, transfer, or rent your account to anyone else.
- You may not create an account to evade a previous suspension or ban.
4. Your content and the license you grant us
You own your content. Anything you post, upload, or otherwise submit to Locaro — including photos, text, reviews, guides, and place lists — remains yours.
To make the Service work, you grant Locaro a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute your content solely for the purpose of operating, providing, and improving the Service (for example, showing your post to your followers, including your guide in search results, or backing up your content). This license ends when you delete the content or your account, except for residual cached or backup copies that are deleted in the ordinary course of business.
This license does not give us the right to use your content (including your username, display name, or avatar) in external marketing, advertising, or promotional materials without your separate consent.
5. Verified creator program
Locaro may, at its sole discretion, mark certain accounts as "verified" (👑 badge). Verification is a discretionary marketing distinction granted and revocable at any time. It is not:
- an endorsement of the verified creator's recommendations or opinions;
- an employment, partnership, or agency relationship;
- a warranty about the quality, accuracy, or safety of any place the creator recommends.
6. Acceptable use
You agree not to use Locaro to:
- post spam, misleading promotions, or paid advertising disguised as recommendations;
- harass, threaten, defame, or stalk any person;
- post unlawful content, hate speech, or content sexualising minors;
- impersonate another person, group, or business;
- scrape, crawl, or otherwise extract data from Locaro by automated means;
- reverse-engineer, decompile, or attempt to derive source code from the app, except as permitted by applicable law;
- use Locaro to develop a competing product;
- interfere with the operation of the Service or the experience of other users.
7. Reports and moderation
Locaro relies on community reports to surface policy violations. We may, at our discretion, remove content, suspend accounts, or take any other reasonable action to protect the Service and its users. We do not pre-moderate content. If your content or account is removed and you believe this was in error, email support@locaroapp.com.
8. Place data
Restaurant and venue listings in Locaro are sourced from the Google Places API. Locaro is not affiliated with, sponsored by, or endorsed by any restaurant or business shown in the app. Hours, menus, prices, closures, contact details, and other information about places may be inaccurate or out of date. Always verify directly with the venue before relying on this information.
9. Third-party services
Locaro depends on services provided by Apple Inc., Google LLC, and Google's Firebase platform. Your use of Locaro is also subject to those providers' terms. We are not responsible for outages, errors, or data loss caused by third-party services.
10. Disclaimer of warranties
LOCARO IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FIT FOR ANY PARTICULAR PURPOSE, OR THAT PLACE DATA WILL BE ACCURATE OR COMPLETE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LOCARO AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED CAD $100.
12. Indemnification
You agree to indemnify and hold Locaro and its operators harmless from any claim or demand, including reasonable legal fees, arising out of your content, your use of the Service, your violation of these Terms, or your violation of any rights of another person.
13. Locaro Pro subscription
Locaro offers an optional auto-renewable subscription, Locaro Pro, which unlocks premium features (such as 30 AI picks per day, unlimited refines, Ask Locaro, pick and snapshot history, and a Pro badge). The core of Locaro remains free.
- Plans and pricing. Locaro Pro is offered as a monthly plan (US$4.99 / month) and a yearly plan (US$39.99 / year). Prices are shown in the app in your local currency and may vary by region; the price displayed on the purchase screen at the time of purchase is authoritative.
- Free trial. New subscribers may be offered a 7-day free trial. If you do not cancel at least 24 hours before the trial ends, it automatically converts to a paid subscription and your Apple Account is charged the price of the selected plan.
- Auto-renewal. The subscription automatically renews for the same period unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours prior to the end of the current period.
- Billing and management. Payment is charged to your Apple Account at confirmation of purchase. All billing is handled by Apple — Locaro never receives or stores your payment details. You can manage or cancel your subscription, or turn off auto-renewal, at any time in Settings → Apple ID → Subscriptions on your device.
- Refunds. Purchases are processed by Apple and are subject to Apple's refund policies. Refund requests are handled by Apple, not Locaro, via support.apple.com/billing.
- Price changes. If we change subscription pricing, the change will not affect your current billing period. Apple will notify you and, where required, request your consent before a renewal at the new price.
Your purchase is also subject to Apple's Apple Media Services Terms (standard EULA).
14. Termination
You may delete your account at any time via Settings → Account → Delete Account. We may suspend or terminate your access to the Service at any time, with or without notice, for any breach of these Terms or for any other reason we deem reasonable to protect the Service or its users.
15. Changes
We may update these Terms from time to time. Material changes will be announced via an in-app banner or App Store release notes, and the "Effective" date at the top of this page will be updated. Continued use of the Service after a change constitutes acceptance of the updated Terms.
16. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
17. Dispute resolution
Before filing any formal claim, you agree to first contact us at support@locaroapp.com and attempt to resolve the dispute informally. We will respond within a reasonable time and do our best to resolve the matter. If we cannot resolve the dispute informally within 30 days, you and Locaro agree to the exclusive jurisdiction of the courts of Ontario, Canada. These Terms do not require arbitration.
18. Severability and entire agreement
If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Locaro regarding the Service.
